Why Tampa Families Bring Us Brain Injury Cases
We Work With the Medical Side of the Case
Brain injury claims live or die on medical documentation. We work with treating physicians and medical experts to connect your symptoms to the injury, including the ones that do not show on a scan.
We Plan for the Long Term, Not the Next Bill
A TBI can affect earning capacity and require care for years. We look past today’s medical bills to what the injury will cost across a lifetime before we discuss settlement.
We Take Insurer Pushback Seriously
Insurers often argue a mild TBI resolved, or that the symptoms come from something else. We build the record, including accounts from family and coworkers about what changed.
No Fee Unless We Win
Your consultation is free and we work on a contingency fee. You pay no attorney fee unless we recover compensation for you.
What Is a Traumatic Brain Injury?
A traumatic brain injury happens when a blow, jolt, or penetrating injury disrupts normal brain function. TBIs range from concussions to severe injuries that cause long-term disability. You do not have to lose consciousness to have one.
Effects can appear immediately or build over days and weeks, which is one reason these claims are so often undervalued early. The cost of treatment and rehabilitation can be significant, and some of it is not spent until years after the crash.
- Memory loss, confusion, and trouble concentrating
- Headaches, dizziness, and nausea
- Vision, hearing, and other sensory changes
- Mood swings, depression, and anxiety
- Impaired motor skills and coordination
Common Causes of Traumatic Brain Injuries in Tampa
If someone else’s carelessness caused the injury, they can be held accountable. We investigate how it happened and identify every party who may be responsible.
Car Accidents
A head striking a window, wheel, or airbag, or the brain moving inside the skull, is enough to cause a TBI.
Truck and Motorcycle Crashes
Higher forces and less protection make brain injuries far more likely in these collisions.
Slip and Fall Accidents
Property owners must keep premises reasonably safe. Falls are a leading cause of serious head injuries.
Pedestrian and Bicycle Crashes
With nothing between the person and the pavement, head impact is common.
Workplace Accidents
Construction sites, warehouses, and other high-risk workplaces see frequent head trauma.
Defective Products
Faulty equipment, failed helmets, and dangerous products can cause serious head injuries.
Signs You May Have Suffered a Brain Injury
TBI symptoms are not always obvious and can develop over days or weeks. If you notice any of these after an accident, see a doctor first. Medical care comes before any legal question, and the records also become part of your claim.
Persistent headaches or migraines
Especially ones that start or worsen after the accident.
Memory lapses or trouble concentrating
Losing track of conversations, tasks, or appointments.
Nausea, vomiting, or dizziness
Ongoing balance problems or a sense that the room is moving.
Sensitivity to light or sound
Rooms and screens that never bothered you before become hard to tolerate.
Mood swings and irritability
Family often notices this before the injured person does.
Sleep changes and drowsiness
Sleeping far more than usual, or not being able to sleep at all.
How We Build a Brain Injury Claim
Investigation and evidence
We gather the crash or incident evidence, the medical records, and the accounts of people who see you every day.
Medical documentation
We work with your treating providers and, where needed, medical experts to document the injury and what it will require.
Negotiating with the insurer
We present the full picture, including future costs, rather than letting an early offer set the value.
Trial, if it comes to that
If the insurer will not deal fairly, we are prepared to take the case in front of a judge and jury.
What a Tampa Brain Injury Claim Is Worth
There is no standard figure. A TBI claim is valued on what the injury costs over time, which is why we do not rush to settle before the medical picture is clear. Future care and lost earning capacity are often the largest parts of a serious brain injury claim.
Florida’s comparative fault rule can reduce recovery, and a two-year deadline applies to most injury claims.
- Medical treatment, now and in the future
- Rehabilitation, therapy, and in-home care
- Lost wages and reduced earning capacity
- Cognitive and behavioral changes
- Pain, suffering, and loss of quality of life
Brain Injury Questions, Answered
Can I have a brain injury if my CT scan was normal?
Yes. Mild traumatic brain injuries frequently do not appear on a standard CT or MRI, which is one reason insurers dispute them. Neuropsychological testing, records from your treating providers, and accounts from family and coworkers about changes in memory, mood, or concentration are often what document the injury.
My symptoms started days after the accident. Does that hurt my claim?
Delayed symptoms are common with brain injuries, and they do not bar a claim. See a doctor as soon as symptoms appear, and if you are using Florida PIP benefits, keep the 14-day treatment window in mind.
How long do I have to file a brain injury claim in Florida?
Two years from the date of the injury for most negligence claims, under Florida Statute § 95.11 as amended by HB 837 in 2023. Different deadlines can apply in some situations, so it is worth asking early rather than late.
Who pays for care I will need years from now?
A claim can include future medical care, rehabilitation, and reduced earning capacity, not just the bills that have already arrived. Those future costs usually have to be documented with medical and financial evidence, which is why we do not settle before the long-term picture is clear.
Is a concussion serious enough to bring a claim?
A concussion is a mild traumatic brain injury, and for some people the symptoms persist for months. Whether a claim makes sense depends on how the injury has affected your health, your work, and your daily life. That is worth a conversation.
